The present applicant, who is arrested by Jalkot Police Station, Tq. Jalkot, Dist. Latur in Crime no.47 of 2015 for the offences punishable under section 302, 201, 120-B, 363, 365, 341 r/w. 34 of the Indian Penal Code, is praying for his release on bail. 3.

The prosecution case would show that it is

2 Cri. Appln. 1796-2016 based on circumstantial evidence, that too according to the learned A.P.P. is based on the statements made by some of the witnesses, that unknown persons were involved in the offence. Certain statements of the coaccused are also relied on. 4.

The applicant was arrested on 27/12/2015. Chargesheet is now filed.

In the circumstances, the following order:- I) The Application is allowed.

II) The applicant be released on bail in Crime no. 47 of 2015 registered with Jalkot Police Station, Tq. Jalkot, Dist. Latur for the offences punishable under section 302, 201, 120-B, 363, 365, 341 r/w. 34 of the Indian Penal Code, upon his executing P.R. bond in the sum of Rs.15,000/- (Rs. Fifteen Thousand) and also upon furnishing surety in the like amount.
