O R D E R

Mr. Pralhad Pandurang Warhade, Executive Engineer, Waghur Project Division Jalgaon, Mr. Ramsing Sulane, Special Land Acquisition Officer, Jalgaon, are present in person before the panel. Mr. B. V. Virdhe,

-2learned AGP for respondent- State and Authorities, Mr. Girish Nagori, learned counsel for appellants-original claimants and Mr. S. D. Dhongade, learned counsel appearing for the Acquiring Body are also present. 2.

These matters are amicably settled between the parties and the compromise/chart prepared as per the terms of the compromise is placed before the Panel by the Mr. Girish Nagori, learned counsel appellants/original claimants. Mr. Pralhad Pandurang Warhade, Executive Engineer, Waghur Project Divisoin, Jalgaon and Mr. Ramsing Sulane, Special Land Acquisition Officer, Jalgaon, are present in person and admit the terms and contents of the said compromise/chart. The compromise/ chart bears their signatures and signatures of Mr. B.V. Virdhe, learned AGP for State of Maharashtra and SLAO, Mr. S.D. Dhongde, learned counsel for respondent-Acquiring body. Thus, the contents of compromise/ chart stand verified. The said compromise/chart is taken on record and marked as 'X' for identification.

These appeals relate to acquisition of the agricultural lands for Waghur project and the Division Bench of this Court in the case of Special Land Acquisition Officer and others Vs. Bhagwat Vithal Sonawane, reported in ( 2009) 4 Mh.L.J. 308 has fixed the market price of Jirayat land at the rate of Rs.2,00,000/- per Hector and Bagayat land at the rate of Rs.4,00,000/- per Hector. These matters are settled in terms of the aforesaid Judgment of the Division Bench.

In view of the above compromise arrived at between the parties, all

-3First Appeals are disposed of accordingly. Refund of court fees as per Rules. Pending civil applications, if any, stand disposed of. 5.

In respect of the enhanced compensation amount, the appellantsclaimants would not be entitled for the interest of the enhanced compensation amount for the period of which delay has been condoned, if any. The appellants-claimants have waived their claim in respect of the trees. The amount of enhanced compensation, as worked out in the compromise/chart will be paid/deposited within one year from today. 6.

Statutory benefits be extended as awarded by the Reference court. 7.

Award/Decree be drawn up in terms of the chart/compromise placed on record as aforesaid.
