The petitioner is the convict, who has been granted emergency parole under Rule 19(1)(C) of the Maharashtra Prisons (Mumbai Furlough and Parole) Rules, 1959, by the Superintendent of Central Prison, Aurangabad vide order dated 03.12.2020. The condition imposed on him is to furnish one personal bond of Rs.10,000/- and two sureties in the sum of Rs.20,000/- each.

The grievance of the petitioner is that this Court should modify the order dated 03.12.2020 passed by the Superintendent of Central Prison, Aurangabad. Reliance is placed on an order passed by this Court dated 04.11.2020 in Criminal Writ Petition No.1258/2020 (Adarsha Gautam Waghmare vs. The State of Maharashtra).

We called upon the learned advocate for the petitioner as to whether, he has made any application to the said Superintendent for modification of the order passed by him on 03.12.2020. The learned advocate concedes that not a single application has been filed for seeking modification.

In view of the above, this Writ Petition is disposed off by permitting the petitioner to file an application before the Superintendent of Central Prison, Aurangabad, on or before 08.04.2021 seeking modification only of the condition of furnishing two sureties in the sum of Rs.20,000/- each. If such an application is filed, the learned prosecutor submits that there would be no difficulty for the Superintendent to convert the said condition into one surety in the sum of Rs.20,000/-.
