Mr. Kulkarni, learned counsel for the petitioner submits that after filing of the present writ petition Collector has withdrawn the notice and it is stated that the issue would now be decided by the Divisional Commissioner.

As the notice itself stand withdrawn, the purpose of the writ petition does not survive. The petitioner would have remedy to assail the adverse order, if passed by the Divisional Commissioner.

In case the Divisional Commissioner seeks to decide the amount of Nazrana, the same shall be done after issuing notice to the petitioner and the same shall be decided expeditiously and preferably within a period of six (6) months. 4.

The writ petition is accordingly disposed of. No costs.

In view of disposal of the writ petition, the civil application also stands disposed of.
