Mr. Madde, learned counsel for petitioner seeks to withdraw this criminal writ petition on the ground that Criminal M.A. No.882 of 2016 filed by respondent No.2 came to be disposed of at the hands of the learned Judicial Magistrate First Class, Omerga. Ms. D. S. Patil, holding for Mr. A. P. Yenegure, learned counsel for respondent No.2 submits that respondent No.2 would take necessary steps to restore the above said criminal miscellaneous application according to law. She submits that the petitioner may be directed to appear in that proceedings after restoration. Having regard to the submissions of both the sides, the criminal writ petition stands disposed of as withdrawn with liberty to the
24 wp.477.17.odt petitioner to file appropriate proceedings according to law. The petitioner shall appear before the Judicial Magistrate First Class, Omerga in a proceedings of recovery of maintenance after restoration of Criminal M.A. No.882 of 2016.
