Heard the learned Assistant Solicitor General for the applicant. Despite service, none has caused appearance on behalf of the respondents-accused.

It has been alleged that there is delay of 266 days caused in preferring the application for leave to present the appeal against the judgment and order of acquittal of respondentsaccused dated 02-01-2015 passed in Regular Criminal Case No. 15 of 2013 by the learned Judicial Magistrate First Class (Railways) Bhusawal, At Bhusawal.

For the reasons stated in the application, the same is allowed in terms of prayer clause "B" and the same stands
