Learned AGP submits that during pendency of these proceedings, the Government has issued fresh policy decision under Government Resolution dated 30.06.2017 and now as per the said policy, registration of the Society will be required to be done.

It is admitted fact that the respondent-society is not yet registered. Now the present policy will have to be considered.

In the light of the above, we pass following order :-

The impugned order is quashed and set aside. The authorities shall consider the policy introduced under Government Resolution dated 30.06.2017 and shall consider grant of no objection certificate and further process be done as per the policy introduced vide Government Resolution dated 30.06.2017. Needless to state that all interested parties shall be heard.

The writ petitions are accordingly disposed of. No costs.
