This is an Application for withdrawal of the amount filed by the claimant.

Learned counsel for the applicant submits that the reasons are stated in the Application for grant of permission to withdraw the amount. It is submitted that there is need of the amount and, therefore, the applicant may be permitted to withdraw the amount. 3.

On the other hand, Shri Dande, learned counsel appearing for the Acquiring Body has no objection if 50% amount is permitted to be withdrawn by the claimant, however, he prays for hearing the matter finally.

In the above backdrop, I permit the applicant to withdraw 50% of the amount deposited in this Court by furnishing undertaking that in case the Acquiring Body succeeds in the present matter, applicant would re-deposit the amount as per directions of this Court within the stipulated period.
