Heard learned counsel for the applicant and the learned Assistant Government Pleader for respondent Nos. 1 and 3. None appears for the acquiring body/respondent No. 2. 2.

Applicant is seeking condonation of delay of 1025 days caused in preferring the first appeal for the reasons stated in the application. As the averments are not controverted, there is no reason to disbelieve the applicant. Apparently no malafides can be attributed to him. Applicant is ready to give up interest and statutory benefits for the delayed period.

For the reasons stated in the application, the civil application is allowed in terms of prayer clause 'B' on condition
