The learned counsel for the petitioner submits that defendant No. 1 has expired and the original power of attorney holder of the defendant No. 1 is the son of defendant No. 1, who would be the legal heir of the defendant No. 1 in the proceedings.

In view of the same, the defendant No. 1 being represented by his son, nothing survives in this petition. The writ petition is disposed of. 3.

Since the civil suit is pending for long time, it is directed to decide the same within a period of three years from the date of production of this order.
