The present application is filed seeking recall of the order dated 22nd March, 2018 issuing bailable warrant to the respondent No. 3 for his absence in contempt petition, though served.

We have heard Mr. Thigale and Mr. Sayyed, the learned counsel for the applicant and the respondent No. 1. The reason is
2 ca 5099.18 given in the application that there were other contempt petitions also and due to confusion inadvertently applicant could not mark his presence in the present contempt petition. Unconditional apology has been tendered by the applicant for his non appearance.

Considering the reasons given and unconditional apology tenders and the fact that, the respondent No. 3 has now appeared through advocate in the contempt petition, the order dated 22nd March, 2018 is recalled. The civil application is disposed of. No costs.
