Mr.Kazi, learned counsel for the petitioner states that the letter dated 20.3.2015, issued by the Chief Executive Officer, suspending the petitioner is illegal and without authority. The Board has not been consulted and without concurrence of the Board, the Chief Executive Officer could not have issued the order of suspension.

Mr.Dixit, learned counsel for the Respondent Nos.2 and 3 submits that in fact, the relief claimed does not survive as the petitioner after filing of this Writ Petition has attained the age of superannuation and the order of suspension would not operate after
the retirement.

In light of the said statement, Writ Petition stands disposed of. In case the petitioner has any grievance with regard to any inquiry, the petitioner is at liberty to take appropriate steps. (V.K.JADHAV,J.) (S.V.GANGAPURWALA,J.) Dt.21.07.2015.
