Advocate for Applicant : Shri Kulkarni R.R. h/f Shri Bhokarikar Madhav M.
...
CORAM : RAVINDRA V. GHUGE, J.
Dated: July 24, 2015 ...
PER COURT :- 1.
Shri Bhokarikar contends that the delay of 267 days in filing this Civil Application seeking the setting aside of the order of the Registrar, dated 29.7.2014, thereby refusing registration for non-removal of office objections, is explained in the Civil Application. The delay is neither inordinate nor deliberate. The applicant gains no advantage by causing delay in filing this Civil Application. If the delay is not condoned, the applicant will be rendered remediless.
2.
In the light of the above, this Civil Application is allowed. Delay of 267 days is condoned, subject to the applicant depositing costs of Rs.1,000/- with the Advocates Association's Bar Library, High Court, Bench at Aurangabad, within a period of three weeks. After the amount is deposited, the order of the Registrar, dated 29.7.2014 shall stand set aside and the Writ Petition will be restored only after the applicant removes all office objections, within a period of five weeks from today. 3.
In the event of non-compliance of this order, the same shall stand recalled, the order of the Registrar shall stand restored and this Civil Application shall stand rejected.
