The challenge in this petition is to the interim order dated 06.04.2023, passed by the Maharashtra Administrative Tribunal (MAT) in Misc. Application No.43 of 2023 in O.A. No.671 of 2021. The petitioner was original applicant. He had asked for relief of setting aside his termination order dated 18.01.2023. The MAT, after hearing the petitioner and the respondents, did not grant the petitioner interim relief. The petitioner approached this Court after about 1 year and 8 months. The O.A. is still pending before the MAT. 3.

Learned counsel for the petitioner adverted our attention to the Order dated 20.12.2022, issued by the Government of

5-sr17 Maharashtra, Department of Medical Education and Drugs, whereby, the respondent - State has granted approval for the petitioner's name for the appointment to the post of `Biochemistry Scientist' (Group "B").

Granting interim relief or stay to the order of termination of the petitioner's service, may tantamount to granting the petitioner final relief. The petitioner approached this Court so late. The issue, which he has raised, is sub judice before the MAT. The petitioner may do well to urge the MAT for early hearing of the O.A. In view of the petitioner's belated approaching this Court, that too, against the interim order, we are not inclined to entertain this petition. The petition, therefore, stands dismissed.
