Manik Baliram Bhore Andors v. Sojarbai Bhausaheb Samudre
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 90 FIRST APPEAL NO. 581 OF 2011 MANIK BALIRAM BHORE AND ORS
VERSUS
SOJARBAI BHAUSAHEB SAMUDRE
CORAM:
VIJAY S.KULKARNI REGISTRAR (JUDL) DATED:
14/02/2017 1.
Perused record and proceedings. The objection notified by the office is that Advocate Shri. S.S.Chaudhari for respondent sole i.e. original claimant has filed pursis dated 06.01.2017 informing that the sole respondent Sojarbai Bhausaheb Samudre has expired on 29/06/2015. The pursis and the copy of death certificate clearly indicates that Sojarbai Samudre has died on 29/06/2015. Thereafter, no steps have been taken by the appellant to bring on record L.Rs. of deceased respondent, if any. There is no representation on behalf of the appellant. No leave note is filed for the learned Advocate for the appellant for today's date. Thus, it appears that the appellant is not really interested in taking steps and to remove the objection. In the result, I pass following order.
ORDER
The appeal against deceased sole respondent Sojarbai Bhausaheb Samudre stands abated.
