The Petitioner has been appointed on compassionate basis on 01/08/2016, since her husband passed away on 19/09/2015. Her proposal for approval dated 28/12/2021, is still pending.

In view of the above, this petition is disposed off. We direct Respondent No.4/ Education Officer (Secondary), to decide the Petitioner's proposal for approval within 30 days from today, on it's own merits, keeping in view that she has been appointed on compassionate ground and the law laid down in

3757.23wp (2) Smt. Yogita Shivsing Nikam Vs. State of Maharashtra and others, 2022 (2) Mh.L.J.370, will be applicable. 3.

In the event of there being any discrepancy in the dates, the Education Officer shall get such dates verified with the Head Master within one week, and accordingly pass appropriate orders.
