Heard learned counsel for the applicant and the learned APP for the respondent/State.

The applicant was not named in the FIR. The incident happened in the dark. No description of the applicant was given in the FIR. Nothing has been recovered from him. There are no antecedents. Considering the progress of the investigation, the detention of the applicant is unwarranted. Hence, the following order.

ORDER

[i] The application is allowed.

[ii] Applicant - Satish Gautam Jamdhade be released on bail on his furnishing PB and SB of Rs. 50,000/- (Rupees Fifty Thousand) 1/2

932-BA-538-2023 with one solvent surety of like amount in Crime No. 0044 of 2023 registered with Chandanzira Police Station, Dist. Jalna, for the offence punishable under Sections 364-A, 385 r/w 34 of the Indian Penal Code, on the following condition - [a] The applicant shall attend the concerned police station as and when called on written notice by the Investigating Officer, till filing the charge sheet.
