Heard the learned Advocate for the applicant. 2.

Inspite of service, none appears for respondent. The matter is therefore taken up for final disposal with the assistance of learned Advocate for the applicant.

This application is filed by the applicant-wife seeking transfer of Petition No. A-9 of 2025 from the Court of learned Judge, Family Court Yavatmal to the Court of learned Judge, Family Court, Parbhani. 4.

It is pointed out that already three proceedings are pending in the Court Parbhani bearing PWDVA No.19 of 2024 pending before the

( 2 ) learned JMFC, Parbhani, RCC No. 202 of 2024 and Petition E No.12 of 2024 under Section 125 of Cr.P.C. pending before the learned Family Court at Parbhani. In two proceedings except PWDVA No. 19/2024, the husband has already caused his appearance.

Considering above position, this Court thus finds that to avoid conflicting judgments and for the convenience of the wife, the proceedings needs to be transferred.

Hence, the following order:-

ORDER

(i) Misc. Civil Application is allowed.

(ii) The proceedings of Petition No. A-9 of 2025 from the Court of learned Judge, Family Court Yavatmal stands transferred to the Court of learned Judge, Family Court, Parbhani. (iii) After transfer of the proceeding, the applicant shall not seek unnecessary adjournments. In case the Trial Court finds that the adjournments are unnecessarily sought, the Trial Court may deal

( 3 ) with such application, so as to compensate the respondenthusband, if he personally remains present. (iv) After transfer the learned Trial Judge shall try to dispose off the proceeding as early as possible and preferably within eighteen

(18) months from the date of transfer.

(v) If the husband makes a prayer to appear through video conferencing, such prayer be considered liberally by the Trial Court.

(vi) With this, Misc. Civil Application stands disposed off. [KISHORE C. SANT, J.]
