This is an application, under Section 439 of the Code of Criminal Procedure, 1973, for grant of regular bail.

The learned counsel for applicants pointed out the role of these applicants that they only driven the car by which the prosecutrix was taken to lodge for commission of alleged incident of sexual assault. The learned APP for the State strongly opposed the application and pointed out that charge-sheet is filed before the learned Judicial Magistrate First Class, Paithan.

913 BA.555.2024.odt The learned counsel for applicants submits that though the charge-sheet alleged to have been submitted, there is no registration of such charge-sheet. The learned APP for the State submits that there might have been any technical difficulties like internet etc. The learned Judicial Magistrate First Class, Paithan is directed to comply with the registration of charge-sheet and its case number as well as hand over a copy of the charge-sheet to the accused concerned. The charge-sheet is filed. Therefore, the applicants have to move application for bail before the Trial Court.
