Applicant has moved this application under section 439 (2) of the Criminal Procedure Code for cancellation of anticipatory bail granted to respondent No.3 by the Sessions Court in Crime No. 385 of 2017 registered with Satara Police Station, Aurangabad for offence punishable under section 354, 506 of the Indian Penal Code.

Heard learned advocate for the applicant and learned Additional Public Prosecutor for the State.

The FIR in question was lodged on 17th August, 2017 and respondent No.3 was granted anticipatory bail by order dated 4th

{2} acb46-18.doc September, 2017. It appears that after completion of investigation, charge sheet came to be filed and the case is numbered as RCC No. 988 of 2018 and the matter is pending before Chief Judicial Magistrate, Aurangabad. 4.

In the light of aforesaid facts, no useful purpose would be served by cancelling anticipatory bail granted by the Sessions Court to respondent No.3. The application is, therefore, dismissed.
