Heard the learned counsel for the applicant, learned APP for the respondent-State and the learned appointed counsel for respondent No.2/victim.

Similarly situated co-accused has been granted bail. Therefore, the applicant deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant AVINASH SUBHASH FALKE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent

35-BA.543-23.odt surety of the like amount, in Crime No.217 of 2022, registered by Police Station Purna, District Parbhani, for the offences punishable under Sections 363, 376, 376(J), 376(D)(A) of the IPC and Sections 4, 6, 7, 8, 10, 11, 12 of the POCSO Act, on the following conditions :

(a) The applicant shall not meet the victim and her family members in any mode or manner till the conclusion of the trial.

(b) He shall not tamper with the prosecution witnesses.

(c) He shall attend the trial on each and every effective date.

(iii)The Secretary, High Court Legal Services, SubCommittee, Aurangabad do pay the legal fees to advocate Patunkar as per the schedule.
