PER COURT :- 1) The present appeals are filed, taking exception to the common judgment and award dated 21.03.2012 passed by 4th Joint Civil Judge Senior Division, Osmanabad in L.A.R. Nos. 605/2000, 149/2000 and 147/2000 respectively. The delay of 1036 days has caused in presenting these appeals. The preset applicants-original claimants therefore pray for condoning the delay so caused.
2) The learned Counsel appearing for the applicants submits that, against the impugned Award, the acquiring body has also filed appeals. (2) 9046-15CA S.P.Rane

BENCH AT AURANGABAD In preferring those appeals also the delay was caused, however, this Court has condoned the said delay and some of those appeals have been disposed of and some are still pending.
3) The learned AGP appearing for the State has strongly opposed for condoning the delay, contending that, the reasons assigned in the applications for condonation of delay are not sufficient 4) After having considered the submissions made by the learned Counsel appearing for the respective parties, it appears to me that, when the appeals filed by the acquiring body have already been admitted and as submitted by the learned Counsel, some of the appeals have been disposed of, no prejudice would be caused if the delay is condoned and the present appeals are also heard on merits. Hence, the following order;
ORDER
a) The delay caused in filing the appeals is condoned. b) The appeals be registered, in accordance with Law. 5) Civil Applications stand disposed of.
