In the present petition, challenge is to the order passed below Exhibit-5 by the Trial Court, which is confirmed by the Appellate Court.

Learned advocate for respondent No.1 has placed on record photocopy of decision in Regular Civil Appeal No. 221 of 2011, in which judgment and decree passed in Regular Civil Suit No. 50 of 2004 dated 4th October, 2011 was challenged. The appeal is dismissed by the appellate court.

In view of disposal of the suit as well the appeal, the present petition has become infructuous and the same is disposed of as infructuous.
