BENCH AT AURANGABAD 62 WRIT PETITION NO. 3481 OF 2018 RANJEETA HIRASWAMI NILWANT

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER ...

Advocate for Petitioner : Mr.Yeramwar Sushant C. AGP for Respondent No. 1 : Mr. A.P.Basarkar Advocate for Respondent No. 2 : Mr. Bondar U.B. ...

CORAM : S.V.GANGAPURWALA AND SUNIL K.KOTWAL, JJ.

DATE : JULY 11, 2018 O R D E R :

The petitioner assails the show cause notice issued to him by the respondent Zilla Parishad. Learned counsel for the petitioner refers to the judgment of this Court in Writ Petition No. 8206 of 2014 filed by the petitioner decided on 17.11.2014. In the said judgment, this Court had protected the services of the petitioner with certain directions.

2.

Learned counsel for the respondent submits that in view of the subsequent judgment of the Apex Court in Appeal No. 8928 of 2015, dated 6.7.2017 the show cause notice is issued. 3.

The order of this Court in Writ Petition No. 8206 of 2014 dated 17.11.2014 is in force. The said order would bind all the

parties to the Writ Petition. The respondents could not have issued show cause notice on the same ground, which has been negatived by this Court in earlier Writ Petition. If some steps are contemplated to be taken by the respondents, the respondents are required to take the steps with regard to the judgment in Writ Petition No. 8206 of 2014.

4.

In the light of above, the impugned show cause notice is quashed and set aside.

5.

With the afore said observations, writ Petition is disposed of. No costs.
