Heard learned Counsel for the applicant. The respondent despite service remained absent.

The applicant - wife is seeking transfer of Hindu Marriage Petition No. 79 of 2022 pending in C.J.S.D., Palghar, Dist. Thane filed by respondent - husband for getting divorce to the Court of C.J.S.D., Gangakhed, Dist. Parbhani. 3.

According to the applicant - wife, she is not having independent source of income and the distance between Palghar and Gangakhed is around 500 Kilometers. Further, the applicant is maintaining one daughter of tender age. As such, it seems difficult for her to attend the dates at Palghar. Pooja K.

972-MCA-97-2023 Moreover, she has also filed proceedings under P.W.D.V. Act and Section 125 of Cr.P.C. against the respondent - husband at Palam.

There is no oppose to the application. Further, respondent - husband will have to attend the dates at Palam in the proceeding filed by the applicant - wife under P.W.D.V Act. Therefore, considering the convenience of applicant, following order is passed :

ORDER

(i) The application is hereby allowed.

(ii) Hindu Marriage Petition No. 79 of 2022 pending in the Court of C.J.S.D. Palghar, Dist. Thane is transferred to the Court of C.J.S.D., Gangakhed, Dist. Parbhani for disposal according to law. (iii) The respondent is directed to appear before the Court of C.J.S.D., Gangakhed, Dist. Parbhani on or before 15th July, 2023.
