The applicant -husband has filed this application for transfer of Hindu Marriage Petition No. 80/2015 pending in the Court of learned Civil Judge (S.D.), Nandurbar to the Family Court at Dhule on the ground that respondent / wife has filed three criminal proceedings at Dhule and therefore, it is highly difficult for him to attend proceedings at two different places.

The learned counsel for respondent / wife strongly objected for such transfer and contended that the applicant / husband shall clear all the arrears of maintenance amount granted to wife in the aforesaid proceedings under Section 24 of Hindu Marriage Act. However, the wife

is already having separate remedy in law to recover those arrears. The record shows that an attempt was made by respondent -wife for seeking same relief as sought in this application by filing Misc.C.A.No.180/2016, which in fact was dismissed.

In view of the same, following order is passed :-

ORDER

1.

The application is hereby allowed.

2.The HMP No.80/2015 pending in the Court of learned Civil Judge (S.D.) Nandurbar is hereby transferred to the Family Court, Dhule.

3.The applicant is directed to appear before the Family Court, Dhule on 10.10.2022.
