We have perused the Circulars dated 24/02/1993, 06/01/2010, 22/11/2019 and 16/02/2021. Vide the Circular dated 06/01/2010, cases in which the judicial Officers are the Petitioners, were transferred to the Principal Seat at Bombay. Matters instituted by the staff members of the High Court and all the District and the Subordinate Courts, were transferred to the respective Benches. By the Circular dated 22/11/2019, all the matters were transferred to the Principal Seat.

However, by the Circular dated 16/02/2021, issued by the Hon'ble the Chief Justice of Bombay High Court, the Circular dated 22/11/2019 has been recalled and the practice prevalent there-before has been restored. The practice prior to the 22/11/2019 was in terms of the Circular dated 06/01/2010, vide which, cases filed by the judicial officers were to be heard by the Principal Seat and the cases filed by the staff members were to be transferred to the respective Benches as per the jurisdiction of the concerned Benches.

We are informed that the Petitioner before us was a Judicial Officer.

In view of the above, this matter would lie before the Principal Seat at Bombay. The Registry of this Court to initiate steps to transfer the said proceeding to the Principal Seat. (R. M. JOSHI, J.)
