The petitioner has approached this Court challenging an order of Passport Authority, refusing to issue Passport to the petitioner on the ground that the State has filed appeal against the petitioner for enhancement of sentence, which is pending in this Court. 02.

Learned Advocate for respondent Nos.1 to 3 raises preliminary objection to the maintainability of the petition stating that the petitioner has to file application in the appeal pending in this Court. 03.

Considering the above, this Court finds that proper remedy to the petitioner is to apply for Passport in the appeal, which is pending in this Court.

In view of the above, this writ petition stands disposed off with liberty to the petitioner to file appropriate application in the appeal pending before this Court.
