1] Learned Advocate for the petitioners and respondent nos.1 & 2 jointly tender a compilation (six pages). Same is taken on record and marked as Exhibit X for identification.

2] Shri R.G. Shirsat submits that Exhibit X would indicate that the proposal of petitioner nos.1 & 2, who are working as Office Assistant and Office Boy, with effect from 16.5.1981 and 3.6.1986 respectively, has been

WP 3800/14 - 2 - sent for regularization and grant of benefits incidental thereto. Shri Suresh D. Dhongade, learned Advocate for the petitioners, submits that the names of the petitioners are shown at Sr.No.103 on page no.4 and at Sr.No.188 on page no.6 of Exhibit X.

3] Shri Suresh D. Dhongade, therefore, submits that the statement of respondent nos.1 & 2 be recorded in the light of Exhibit X and this petition can be disposed of. Shri R.G. Shirsat, learned Advocate for respondent nos.1 & 2, is agreeable.

4] In the light of the above recorded statements and Exhibit X, this petition is disposed of. It is, however, made clear that the petitioners shall not be terminated only on the ground of they being temporary till the order of regularization is passed. However, this protection shall not be extended to acts of mis-conduct and disciplinary proceedings.
