Heard Mr.U.U.Wagh, learned counsel for the applicant and Mr.S.G.Chapalgaonkar, learned counsel for respondent No.1. 2.

Mr.Chapalgaonkar, learned counsel for the respondent No.1 Insurance Company submitted that involvement of the vehicle in the accident itself is in question. Therefore, the applicant is not entitled to withdraw even a single farthing.

Having regard to the above submission, the applicant is permitted to withdraw 50% of the amount deposited by the respondent No.1 Insurance Company on giving an undertaking that the applicant shall deposit the amount in the Court as and when directed. Rest of the amount be deposited in the Fixed Deposit. 4.

Civil Application is disposed of.
