Heard the learned counsel for the applicant and the learned APP for the State.

Interim protection was granted to the applicant by order dated 31st March, 2021. However, the Investigating Officer has submitted a report contending that an application under section 169 of the Code of Criminal Procedure has been submitted. The said application is still pending before the Court. A copy of the said report is taken on record and marked as Annexure '

A'.

The development of investigation reveals that the prosecution does not want to proceed against the applicant. An application under section 169 of the Cr. P. C. has already been submitted to the Court of law, however, it is pending.

In the circumstances, the application deserves to be allowed. Hence, the following order:

O R D E R

(i) The application is allowed.
