By this application, the applicant prays for condonation of delay of 40 days in lodging the second appeal in this Court. Reasons are set out in paragraph Nos.3 and 4.

Mr.Bora, learned Advocate opposes the said application and submits that the circumstances and reasons put forth do not justify condonation of delay.

Having considered the submissions of the rival sides and for the reasons set out in the civil application, the same is allowed. Delay of 40 days is condoned subject to the applicant depositing khs/March 2015/6605-13 (d)

costs of Rs.5,000/- (Rs.Five thousand only).

Mr.Bora, learned Advocate graciously submits that the said costs be paid to the Advocates' Bar Library, High Court, Bench at Aurangabad. As such, the applicant shall deposit costs of Rs.5,000/- (Rs.Five thousand only) with the Advocates' Bar Library, High Court, Bench at Aurangabad, within a period of 3 (three) weeks from today, failing which this order shall stand recalled and the civil application shall stand rejected.
