This petition has been fled by the petitioner through jail. He prays for a decision on his application dated 01.01.2020, which he has fled for seeking furlough leave, with the Deputy Inspector General (Prisons), Aurangabad through the Superintendent, Aurangabad Central Prison. 2.

The learned Additional Public Prosecutor submits, on instructions, that due to miss communication and the National Lock Down in March, 2020, the said application is pending and same would be adjudicated upon by the Dy. Inspector General (Prisons) within 10 days.

The learned Additional Public Prosecutor further brings to our notice that the present petitioner had earlier obtained parole leave on 06.08.2015, and was released on 31.08.2015 ,

914- Cri. W. P. No. 433-2021.odt from the Prison. Thereafter, instead of reporting back after the expiry of the parole leave, the petitioner absconded and was untraceable for 1486 days. He fnally had to be traced out and was arrested after the said period of 1486 days. 4.

Considering the above, this petition is disposed of by recording the statement made by the learned public prosecutor on instructions, that the pending application of the petitioner dated 01.01.2020, shall be decided by the Dy. Inspector General (Prison), Aurangabad on or before 5th April, 2020, on it's own merits.
