IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD.
WRIT PETITION NO. 7433 OF 2012 Hameedbin Abdullah Bazman Petitioner.
Versus
The State of Maharashtra and others Respondents.
*** None for the petitioner.
Mr. Y.G. Gujrathi, A.G.P. for the State.
*** CORAM :
RAVINDRA V. GHUGE AND SUNIL K. KOTWAL, JJ.
Dated :
24-11-2017.
ORAL ORDER :- 1.
None appeared for the petitioner on the previous dates. We adjourned the matter on 14.11.2017 and posted it for this date for passing orders on dismissal. The matter is shown on the Board for "passing orders". Yet, none appears for the petitioner. 2.
As such, we could have dismissed this matter in default. However, we have perused the prayer put-forth by the petitioner at ClauseB, which reads as under :- "B.
By issuing writ of mandamus or any other appropriate writ or directions the respondent Nos.2 to 4 may kindly be directed to adjudicate the claim of petitioner for compensation of land Sy.No.2 situated at Jafarabad, Tq. Jafarabad Dist. Jalna"
(2) WP No.7433/2012 3.
The petitioner is, therefore, praying for a direction to adjudicate his claim for compensation for land Survey No.2 at Jafrabad, District Jalna.
4.
Learned A.G.P. submits that he has no instructions in the matter.
5.
Considering the above, this Petition is disposed of with a direction to respondent No.2, to consider the prayer of the petitioner and if any claim of the petitioner for compensation towards land Survey No.2 situated at Jafrabad is pending adjudication, the same shall be adjudicated upon expeditiously by following the due procedure laid down in law. 6.
We make it clear that we have not expressed any opinion about the merits of the claim of the Petition. ( SUNIL K. KOTWAL) ( RAVINDRA V. GHUGE) JUDGE JUDGE vdd/
