IN THE HIGH COURT OF JUDICATURE AT BOMBAY.

BENCH AT AURANGABAD.

WRIT PETITION NO. 5226 OF 2019 Prabhakar S/o Bhausaheb Bhambhalkar

...Petitioner

Versus

Smt. Indubai W/o Bhausaheb Bhambalkar

...Respondent

Mr. A.M. Gholap, Advocate for petitioner CORAM : RAVINDRA V. GHUGE, J.

DATE : 14th JUNE, 2019 PER COURT:

1.

The petitioner, who is the biological son of the respondent, is aggrieved by the order dated 20th December, 2017 passed by the Trial Court in Reg. civil suit No. 751 of 2015, by which, he is directed to pay an amount of Rs. 2500/- per month as maintenance amount to his mother.

2.

The learned Advocate for the petitioner has strongly criticised the impugned order. He has drawn my attention to the grounds formulated by him in the memo of the petition and I have considered the petition paper book with his assistance. 3.

Considering the pleadings of the parties and the

2 W.P. No. 5226/2019 circumstances recorded by the Trial Court in the impugned order, I do not find that the order can be termed as being perverse or erroneous.

4.

This petition, being devoid of merits, is therefore, dismissed.

5.

The learned Advocate for the petitioner submits that considering the nature of the dispute, the suit may be expedited. 6.

I find that the mother is about 68 years of age and has been required to approach the Trial Court. Taking into account this factor, the Trial Court is requested to decide the Reg. Civil suit No. 751 of 2015 as expeditiously as possible and preferably on or before 29th February, 2020.
