Respondent No.2 has filed an affidavit in reply dated 26.10.2016. It is specifically stated that since the petitioner has joined at the place of work, the impugned show cause notice dated 24.10.2013 has not been acted upon. It is stated that the said notice was aimed at ensuring that the petitioner would join the place of work.

Considering the above, this petition is disposed off in the light of the affidavit in reply and especially paragraph No.6 therein. 3.

In so far as the period of absence of the petitioner, which the petitioner justifies and the respondent contends it to be unauthorized absenteeism, the representation of the petitioner for seeking salary for the said period is kept open for the respondent /

WP/3916/2014 establishment to consider on it's own merits and in accordance with the service conditions applicable. Rights of the parties on this issue are kept open.
