This appeal is filed against the order dated 07-03-2020 passed by the learned Special Judge, Aurangabad in Criminal Bail Application No. 187 of 2020.

The appellant filed the aforesaid application for anticipatory bail apprehending his arrest in crime No. 13 of 2020 registered by Bidkin Police Station for the offences punishable under Sections 354, 323, 506, of the Indian Penal Code and Section 3(1)(w)(i)(ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The learned Special Judge rejected the application by the order impugned.

The learned APP for the respondent/State submits that on 21-03-2020 the Investigating Officer has filed B-Summary report before the Special Court.

In view of this, I do not see any reason to entertain the present appeal and the prayer to release the appellant on anticipatory bail.

The appellant is, however, granted liberty to approach this court if the B-summary filed by the Investigating Officer is not accepted by the Special Court. If such eventualities arises the Investigating Officer shall give prior notice to that effect to the appellant and shall not arrest him for three days from the date of service of the said notice.
