2] The learned AGP appearing for the respondentsState, on instructions, submits that the respondents/authorities have canceled the previous auction process initiated on the basis of the tender notice dated 23rd March, 2016 published in 'Daily Lokmat'.

3] In that view of the matter, for the reasons which are assigned in the interim order dated 28th

2 10-PIL-45-16.odt March, 2016, we allow this Public Interest Litigation in terms of prayer clause (B).

4] Needless to observe that if the respondents/ authorities have undertaken the auction process, the same should be in accordance with the guidelines issued in the Government Resolution dated 12th March, 2013 and other relevant procedure prescribed by the Government.

5] The learned counsel appearing for the petitioner graciously submits that an amount of Rs.5,000/- out of the amount deposited by the petitioner, may be given to the Library, High Court Bar Association, Aurangabad.

6] In that view of the matter, the Registry to return an amount of Rs.20,000/- (Rs.Twenty Thousand) to the petitioner and give an amount of Rs.5,000/- (Five Thousand) to the Library, High Court Bar Association, Aurangabad.

8] The parties to act on authenticated copies of this order.
