Mr. Phatale, the learned Counsel submits that the petitioner has completed B.Sc. Nursing, however her degree certificate and other documents are not issued on the ground that claim is pending with the committee for validation of her tribe claim.

The learned A.G.P. submits that, unless the petitioner submits the tribe certificate, the degree certificate and other original documents cannot be given to her.

Heard the learned Counsel for respondent no. 1 and the learned A.G.P.

According to Mr. Phatale, the learned Counsel, yesterday the petitioner has been issued notice by the committee and the vigilance is conducted again.

Considering the above, we pass the following order.

The committee shall decide the validation proceeding in respect of the tribe claim of the petitioner expeditiously and preferably within a period of four (04) months from the date of appearance of the petitioner. The petitioner shall appear before the committee on 17.08.2020.

The respondents shall not issue degree certificate to the petitioner unless the petitioner produces the validity certificate, however other documents which the petitioner has filed may be returned to the petitioner.

As far as the degree certificate is concerned, decision shall be taken by the respondents depending upon the judgment that will be delivered by the committee in the validation proceeding.

Writ Petition is accoridngly disposed of. No costs.
