The State of Maharashtra RESPONDENT ---- Mr. Joydeep Chatterji, Advocate for the applicants Mr. V.P. Kadam, A.P.P. for the respondent-State ---- CORAM : M.T. JOSHI, J.
DATE : 29/04/2015 ORAL ORDER :
1.
Heard both sides.
2.
The present applicants, who are apprehending
their arrest at the hands of Newasa Police Station, Taluka Newasa, District Ahmednagar, in Crime No. I288/2014, registered for the offences punishable under section 302, 201 of the Indian Penal Code, are praying for their release on bail in the event of their arrest. 3.
The earlier application of the present applicants, bearing Criminal Application No. 6402/2014, for similar relief, was decided by this Court on 02.12.2014. At that time, the anticipatory bail was granted to the present applicants for a period of four months from the date of the said order since the investigation was then in progress, in the facts and circumstances as detailed in the said order.
4.
Now, after a period of four months, there is no change in the circumstances. On the other hand, the statement of Tarabai who was claiming to be the eye witness to the incident, is on the same line as that was before the recording of the FIR that it was a case of accidental death and there is only suspicion. In the circumstances, the following order:- 5.
The anticipatory bail granted to the present
applicants, for a limited period, vide order dated 02.12.2014, passed in Criminal Application No. 6402/2014, is hereby made absolute on the same terms and conditions, except the condition of attendance with the concerned Police Station.
.
The application is accordingly disposed of.
