The petitioner has put forth a simple prayer that his representation dated 23.02.2021 addressed to respondent No.2/ District Collector, be considered.

We have perused the said representation. The petitioner in fact desires to initiate disqualification proceedings against some of the elected members of the Gram Panchayat, on account of encroachment, u/s 14(1) of the Maharashtra Village Panchayat Act. The representation dated 23.02.2021, is not in proper format. The petitioner will have to prefer such an application by correcting the relevant provisions and by khs/June 2022/5187

- 2 - mentioning the names of the applicants Vs. the names of the respondents and then request the District Collector to initiate the proceeding.

The learned Advocate for the petitioner submits on instructions that the petitioner would file such a appropriate complaint and request the District Collector to commence the proceedings u/s 14(1). 4.

In view of the above, this petition is disposed off. Needless to state, if the petitioner prefers such a complaint, the District Collector would consider the same strictly in accordance with the procedure laid down in Law and by granting reasonable opportunity of hearing to all the contesting parties.
