The applicant is real brother-in-law of the informant. It has been alleged in the F.I.R. that the applicant committed theft of Rs.3 lakhs from the residence of informant.

It appears that the informant suspects applicant' s involvement in the crime is question. The F.I.R. has been lodged nine days after the alleged incident. Stolen money did not bear any earmark so as to attribute the same to the informant and to be recovered from the applicant if he is taken into custody.

In the factual backdrop of the case, the applicant needs to be granted anticipatory bail. Hence the following order :- 1 / 2

ORDER

(I) Application is allowed.

(II) In the event of arrest of the applicant, in connection with Crime No. 98 of 2023 registered with Hingoli Rural Police Station, Dist. Hingoli for the offence punishable under Section 380 of the Indian Penal Code, he be released on executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety in the like amount.

(III) The applicant shall appear before the investigating officer, as and when required for the investigating purpose. (IV) The applicant shall not tamper with the prosecution evidence.
