BENCH AT AURANGABAD 11 WRIT PETITION NO.4059 OF 2022 BAL SHIKSHAN MANDAL THR ITS PRESIDENT NAMELY ARVIND DATTATRAYA GANPULE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioners : Mr. Nagargoje Ankush N. AGP for Respondents-State : Mr. S. B. Yawalkar. ...

CORAM : R. D. DHANUKA, AND S. G. MEHARE, JJ.

DATE : 04.04.2022 PER COURT :- 1.

A short grievance of the petitioner in this petition is that though the petitioner has applied for renewal of the registration on 22.05.2018 as per amended provisions of the Juvenile Justice Act, the said proposal is still pending before respondent No.1.

2.

Learned counsel for the petitioner invited our attention to the order dated 03.09.2021 passed by the Division Bench of this Court in Writ Petition No.9061 of 2021 and would submit that similar order may be passed in this petition also.

3.

We accept the statement made by the learned counsel for the petitioner that the said application for renewal is still pending since 2018. We accordingly direct respondent No.1 to dispose of the said application within a period of four (4) weeks from the date of communication of this order. The order that would be passed shall be communicated to the petitioner within a period of one (1) week from the date of passing such order. If the application for renewal is allowed, the registration already granted to the petitioner shall be renewed within a period of two (2) weeks from the date of allowing such application. If the order is adverse against the petitioner, no coercive steps shall be taken against the petitioner for a period of four (4) weeks from the date of communication of order. During the pendency of the said application for renewal, the petitioner shall not allow new elements. No coercive steps shall be taken against the petitioner till the said application for renewal is decided and for a period of four (4) weeks thereafter, if the same is adverse against the petitioner. 4.

Writ Petition is disposed off in the aforesaid terms. No order as to costs.

5.

Parties to act upon authenticated copy of this order. (S. G. MEHARE, J.) (R. D. DHANUKA, J.) ...
