Mahendra S/O Balasaheb Tupke v. The State Of Maharashtra
1 16-crappln1766-15.odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD CRIMINAL APPLICATION NO.1766 OF 2015 Mahendra s/o. Balasaheb Tupke ..Applicant
Versus
The State of Maharashtra ..Respondent -- Mr.Santosh Bhosale, advocate i/b. Mr.H.S.Bedi, advocate for applicant Mrs.B.B.Gunjal, APP for respondent - State -- CORAM : M.T. JOSHI, J.
DATE : JUNE 30, 2015 PER COURT :
Heard both sides.
2] Reading of the earlier order passed by this Court dated 23rd June, 2015, would show that when this Court had made a query to learned counsel for the applicant about filing of the earlier application by the applicant seeking bail and rejection thereof by this Court, he submitted that he has no instruction and therefore, some time was sought for.
2 16-crappln1766-15.odt 3] Considering all these facts on record and finding that the applicant has not mentioned about filing of the earlier application by him for bail and its rejection by this Court, without going into merit of the case, present application deserves to be dismissed.
4] Mr.Bhosale, learned counsel appearing for the applicant submits that the applicant wishes to withdraw the present application.
5] However, taking into consideration the above facts, withdrawal of present application is not permitted.
6] The application is, therefore, rejected.
