Taking into consideration that the present appeal was the outcome of challenge to the rejection of the bail application filed under Section 439 of Cr.P.C., by learned Special Judge, Aurangabad on 17.3.2021, and the fact that the entire investigation is over, learned Advocate Mr. Bolkar, appearing for the applicant, he may be allowed to go before the same court after considering the evidence that has been put forward by way of charge sheet. Under such circumstance, the Criminal Appeal stands disposed of as withdrawn with liberty to the appellant to go before the

(2) learned Special Judge. Liberty is granted to file an application under Section 439 of Cr.P.C. after charge sheet.
