Heard the learned counsel for the petitioner. 2.

The disputed mutation entry was made in the year 1993 and the same was challenged in the year 2017. The said proceeding was dismissed on the count that there is delay of 24 years in filing the application and the petitioner can obtain relief from the civil court. It is the contention of the petitioner that there is no partition deed between the parties and as such, the mutation entry ought not to have been taken in the year 1993. 3.

Considering that there is substantial delay in challenging the mutation entry and the petitioner can get his civil rights' adjudicated before the civil court and considering that the mutation entries are for fiscal purpose and they are subject to outcome of the civil proceedings, the petitioner is at liberty to take such recourse as is available in law. 4.
