Heard learned advocate for the applicant.

This application is filed seeking permission to withdraw the amount of compensation deposited by the appellant in the office of this Court pursuant to judgment and award passed by the learned Member, MACT, Dhule. The amount deposited is Rs. 1,87,403/- including interest. Considering that, it's a meager amount towards injury claim this Court is inclined to pass the following order :

ORDER

(I) The civil application stands allowed.

3 929-CA 8851-2025.odt (II) The applicant is allowed to withdraw the entire amount along with accrued interest by furnishing usual undertaking in the office of this Court.

(III) With this, the civil application stands disposed of. CIVIL APPLICATION NO. 3669 OF 2025 :

Since the entire amount as per the impugned judgment and award is already deposited in the office of this Court along with interest, the application for stay stands allowed in terms of prayer clause (C).

The civil application for stay stands disposed of. CIVIL APPLICATION NO. 3668 OF 2025 :

This application is for condonation of delay of 378 days caused in filing the first appeal by the insurance company. 2.
