APPELLATE SIDE, BENCH AT AURANGABAD CRIMINAL WRIT PETITION NO.459 OF 2015 (Azher Khan s/o Pasha Khan Vs. The State of Maharashtra & anr.) Office Notes,Office Memoranda of Coram, appearances, Court's orders or directions and Court's or Judge's orders Registrar's orders Shri M.A. Latif, Advocate for petitioner (absent) Shri K.S. Patil, A.P.P. for State .....

CORAM :

S.S. SHINDE AND A.I.S. CHEEMA, JJ.

DATED :

7th August, 2015.

1.

When the matter is called out, none appears for the petitioner. There are two prayers in the petition, one for compensation and another is for seeking directions to release the Tempo bearing No.NH-20/CT-8567. Learned A.P.P., on instructions, makes a statement that the aforementioned vehicle is already released by the concerned Police Station on 8.4.2015. So far compensation is concerned, since the question relates to the detention of the vehicle and not of a person, it is not desirable to adjudicate the said prayer. If the petitioner has sustained any loss on account of seizure of the vehicle and if the petitioner feels that such seizure of vehicle was illegal, he can resort to appropriate remedy as available in law. Petition stands disposed of. (A.I.S. CHEEMA, J.) (S.S. SHINDE, J.) fmp/cri1004.14
