This application is filed by the wife for transfer of Petition No. A-464/2023 filed by the Respondent/Husband in Family Court, Pune under Section 13(1)(ia) of the Hindu Marriage Act for claiming divorce.

According to the Applicant, her marriage was solemnized with non-applicant on 05.05.2021. According to her, after marriage she started cohabitation with the husband in a joint family at Pune. She was initially treated well by her in laws. It is alleged that thereafter she was subjected to physical and mental harassment at the hands of non-applicant and her in laws. Ultimately she was required to stay with her

974-MCA-90-2024.odt parents at Ahmednagar for last 2 1⁄2 years. It is claimed that her parents suffer old aged ailments and they require regular medical treatment and assistance of Applicant. It is claimed that the distance between Ahmednagar and Pune is 110 km and being lady with responsibility of parents, she find it difficult to attend proceedings at Pune.

Respondent in spite of service, failed to remain present the Court which indicates that he has no inclination to oppose the application.

In view of above, application is allowed in terms of prayer clause 'B'.
