In-fact, the application was heard on the last date i.e. on 31/03/2016 and finding that this Court is not inclined even to issue notices, learned counsel for the applicant sought time to have instructions regarding the withdrawal, if any, of the present application.

Complaint filed by Mr. Santosh Sabale, Assistant Regional Manager of Ajit Seeds, Beed would

2 Cr. Appln. 1850/2016 show that the present applicant has indulged in preparing spurious seeds, purporting to be the seeds manufactured by M/s Ajit Seeds. Upon enquiry, the said fact is established, as is narrated in the FIR. The applicant has submitted that in-fact the present applicant has closed his shop earlier to the present episode.

The defence, at this stage, cannot be taken into consideration. Considering the fact that the seed on large scale was apparently brought into the market though not prepared by the authorized seed company, this is not a fit case even for issuing notices. The Application is therefore dismissed.
